Fence Company in Cavalier, ND

Vinyl, wood, chain link and ornamental fencing, built to the height the ordinance actually allows.

Most towns this size leave the fence question vague. Cavalier does the opposite. The council rewrote the fence ordinance in September 2024, and it is now the most specific in the region, down to how the height is measured and what the gate has to do if your meter ends up inside the fence.

That is good news if you want a real privacy fence, because the side and rear yard allowance here is 8 feet, higher than most towns nearby. What it does not change is what happens below the line: posts driven past the frost line into stable ground rather than floated in a shallow collar of concrete, so a Tongue River valley winter has nothing to lift.

Fence Rules in Cavalier, ND

Cavalier rewrote its fence ordinance in September 2024. It is unusually detailed for a town this size, and almost every clause changes something about the layout. Here is what it says, with the official sources linked below.

  • A fence, wall or hedge up to 8 feet may occupy the required side or rear yard. The height is measured from flat, natural ground height on both sides of the fence.
  • Nothing over 4 feet may be built in the front yard, beyond the front line of the structure, or within the applicable 20-foot setback from the street, whichever is farther back. No fence may be built on City right of way or public property.
  • A fence must be placed at least 1 foot away from a property line.
  • It may sit on the rear property line only where that line does not abut an alleyway or a city easement for water, power or other utilities. Where the rear line abuts an alleyway it must be no closer than 5 feet, and no fence may be placed on land covered by a city easement.
  • Where the fence encloses an electric, water or gas meter, it needs a gate with a bottom clearance of at least 3 inches and latching hardware that works from both sides. Building such a fence counts as the landowner’s permission for city employees and utility providers to enter the enclosed area for purposes such as reading meters.
  • Fences must be built from weather resistant material consisting of new wood, metal or vinyl. Barbed wire is prohibited in any residential zone, and in a commercial or industrial zone it is allowed only as part of a chain link enclosure and must sit at least 6 feet above ground level.
  • A fence or wall left in a weakened or structurally deficient condition is a public nuisance and may be abated by the city.

Fence Installation FAQs for Cavalier, ND

Heights, setbacks, materials, meter access and long-term durability in Cavalier conditions.

Up to 8 feet in the required side or rear yard, which is higher than most towns nearby allow. In the front yard, beyond the front line of the house, or within the 20-foot street setback, whichever is farther back, nothing over 4 feet. The ordinance measures height from flat, natural ground on both sides of the fence, so a difference in grade between two lots matters.

No. The ordinance requires at least 1 foot of clearance from a property line. A fence may sit on the rear property line only where that line does not abut an alleyway or a city utility easement. Where it abuts an alleyway the fence has to stay 5 feet back, and nothing may be built on land covered by a city easement.

Not under the current ordinance. It requires weather resistant material consisting of new wood, metal or vinyl.

Yes. The fence needs a gate with a bottom clearance of at least 3 inches and latching hardware accessible from both sides. Building a fence around a meter also counts as the landowner’s permission for city employees and utility providers to enter the enclosed area, for meter reading and similar purposes.

Not in any residential zone. In a commercial or industrial zone it is permitted only as part of a chain link enclosure, and it must sit at least 6 feet above ground level.

Post depth and how each post is set. This far north the frost drives deep, and a shallow footing lifts a little each spring until the line goes crooked and the gates stop closing.

Yes. Cavalier’s fence ordinance treats a fence or wall left in a weakened or structurally deficient condition as a public nuisance that the city may abate. This far north, that weakness usually starts at the posts, when frost lifts a shallow footing a little each spring. See our fence repair page for how the work is done.
