Fence Rules Are Set City by City in Minnesota

Minnesota’s state building code generally exempts fences of seven feet and under from a state building permit, but cities can and do require their own permit regardless of height, and several of the cities we work in do exactly that. Here is where they stand.

East Grand Forks — a permit is required for every fence with no height exemption, fences must sit at least a foot from the property line, and the finished side must face the street or the neighboring property.

Thief River Falls — the City amended its ordinance in October 2025 to require a permit for all fences. Parts of the City’s own website still show the old exemption for fences under seven feet.

Bemidji — much of the city falls inside the shoreland overlay covering Lake Bemidji, Lake Irving and the Mississippi corridor, which adds requirements on top of the base zoning district.

Crookston — you must be a licensed contractor to pull a fence permit, and a homeowner should not take one out for work a contractor is doing.

Red Lake Falls has no fence section in its zoning code at all, so setbacks come from the zoning district schedule. In Glyndon the answer depends on whether a property sits inside city limits or in the township. In Roseau the 2017 flood map revision removed nearly all structures inside the city limits from the regulatory floodplain, and what is still inside it falls under the city’s floodplain ordinance.
